These Terms of Service ("Terms") govern your use of AgentX's business automation, messaging, and AI workflow services provided through byagentx.ai. By purchasing, accessing, connecting business assets to, or using our services, you agree to these Terms.
AgentX provides automation and messaging services for businesses, including but not limited to:
The specific services delivered are defined by the selected plan, statement of work, written approval, or onboarding agreement. Service scope and deliverables will be confirmed during onboarding.
Some AgentX services rely on third-party platforms such as Meta, WhatsApp Business Platform, Facebook, Instagram, Stripe, Cloudflare, Google Workspace, hosting providers, and other business tools authorized by the client. When you connect or authorize use of these platforms, you agree to comply with their applicable terms, developer policies, commerce rules, messaging policies, and privacy requirements.
For WhatsApp Business Platform services, you are responsible for ensuring that your customer communications comply with WhatsApp Business Messaging Policy, template approval requirements, opt-in requirements, applicable law, and any industry-specific restrictions. AgentX may help configure and operate the workflow, but the client remains responsible for the accuracy, legality, and appropriateness of business content, offers, and customer communications.
By connecting a business portfolio, WhatsApp Business Account, phone number, Page, Instagram account, ad account, catalog, or other business asset to AgentX, you represent that you are authorized to grant access to that asset. You authorize AgentX to access, configure, process, and operate the connected assets only as needed to provide the requested services.
AgentX does not claim ownership of your business assets or customer relationships. You may request disconnection, access removal, or deletion of data controlled by AgentX according to our User Data Deletion Instructions.
You agree not to use AgentX to:
We may suspend or terminate services if we reasonably believe the service is being used in a way that violates these Terms, platform rules, law, or creates risk for AgentX, our clients, platforms, or end users.
You may cancel a monthly subscription by providing 30 days' written notice to [email protected], unless a written agreement states a different cancellation period. Your service will continue until the end of the current billing period following the notice period.
Setup fees are non-refundable once work has commenced. Monthly fees already paid are non-refundable unless required by law or agreed in writing.
We target efficient setup and go-live timelines, often within 72 hours for standard implementations, subject to timely provision of required materials, access, approvals, platform review times, and third-party availability. Complex custom projects, Meta/WhatsApp reviews, account verification, domain/DNS changes, and external platform approvals may require additional time.

AgentX processes personal data and platform data only as needed to provide requested services, support, security, compliance, and operations. Our Privacy Policy explains what we collect, how we use it, how deletion requests work, and how to contact us: Privacy Policy.
You are responsible for providing any required notices and obtaining any required consents from your customers, employees, or end users before using AgentX workflows to process their information.
AgentX may use AI systems to classify messages, draft replies, summarize conversations, route leads, or assist with operations. AI output can be inaccurate or incomplete. Clients are responsible for reviewing and approving any business-critical, legal, medical, financial, pricing, contractual, or regulated content before relying on it or sending it to customers.
Custom work, content, and configurations created specifically for your business become your property upon full payment, except for AgentX's pre-existing tools, frameworks, prompts, software, templates, methods, and reusable components. AgentX retains rights to its underlying technology and methodologies used to deliver the service.
AgentX provides its services "as is" and makes no guarantees of specific business outcomes, revenue increases, ad performance, message delivery, platform approvals, or account review results. Third-party platforms may change their APIs, policies, pricing, review requirements, or access at any time.
To the maximum extent permitted by applicable law, AgentX shall not be liable for any indirect, incidental, special, consequential, or lost-profit damages arising from the use of our services. Our total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you to AgentX in the three months preceding the claim.
We may update these Terms from time to time. We will notify you of material changes by email or by posting an updated version on our website. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Mexico. Any disputes shall be resolved through good-faith negotiation; if unresolved, through the competent courts of Mexico City, unless mandatory law requires otherwise.
