Terms of Service

These Terms of Service ("Terms") govern your use of AgentX's AI automation services provided through byagentx.ai. By purchasing or using our services, you agree to these Terms.

1. Services

AgentX provides AI-powered automation services for businesses, including but not limited to:

• WhatsApp bot setup and management
• AI-powered business websites with chat
• Social media automation and content generation
• SEO strategy and AI content creation
• Custom business automation workflows

The specific services delivered are defined by the plan purchased at the time of checkout. Service scope and deliverables will be confirmed during onboarding.

2. Pricing and Billing

• Setup fees — a one-time fee charged at the time of purchase to cover initial configuration, onboarding, and build work.
• Monthly fees — recurring charges billed monthly for ongoing service, maintenance, and support.
• Prices are displayed in USD. Payments in MXN are approximate and subject to your bank's exchange rate at the time of transaction.
• All payments are processed securely through Stripe.

3. Cancellation Policy

You may cancel your monthly subscription at any time by providing 30 days' written notice to [email protected]. Your service will continue until the end of the current billing period following the notice period.

Setup fees are non-refundable once work has commenced. Monthly fees already paid are non-refundable.

4. Setup and Delivery Timeline

We target a setup and go-live timeline of 72 hours from the start of onboarding, subject to timely provision of required materials and information by the client. Complex custom projects may require additional time, which will be communicated in advance.

5. Client Responsibilities

To enable effective delivery of services, you agree to:

• Provide accurate business information during onboarding.
• Grant necessary access to platforms and tools as required (e.g., WhatsApp Business, social accounts).
• Respond to onboarding communications in a timely manner.

6. Intellectual Property

All custom work, content, and configurations created specifically for your business become your property upon full payment. AgentX retains rights to underlying tools, frameworks, and methodologies used to deliver the service.

7. Limitation of Liability

AgentX provides its services "as is" and makes no guarantees of specific business outcomes, revenue increases, or performance metrics. To the maximum extent permitted by applicable law, AgentX shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.

Our total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you to AgentX in the three months preceding the claim.

8. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of Mexico. Any disputes shall be resolved through good-faith negotiation; if unresolved, through the competent courts of Mexico City.
